Prenup helps eliminate complexities in high asset divorce

One of the more recent Hollywood splits left some people in Louisiana and other states surprised because the divorce was practically over by the time rumors about it coming had leaked through grocery store tabloids. In the majority of cases, a celebrity divorce results in a complex division of assets but the dissolution between Tom Cruise and Katie Holmes seemed to be anything but complex.

According to reports, Holmes got nothing from the split. The couple's child, Suri, is receiving $400,000 a year from her father in child support until she turns 18. Reports indicate that despite the 33-year-old actress not receiving anything, she is still very happy with the divorce settlement.

So what made this couple's divorce, which has been called one of the fasted settled divorces in Hollywood history, so quick and simple? One may be that it wasn't so quick. According to court documents revealed by one tabloid, the relationship had actually been on the rocks six months before Holmes filed for divorce in New York. That's understood to be the case because New York law requires that one of the parties in a divorce has to claim irreconcilable differences for at least six months before the papers can be filed.

Many experts have also pointed toward the couple's decision to file a prenuptial agreement. The couple had signed such a prenuptial agreement months before the wedding. The presumption is that the prenuptial agreement, taking into account Holmes' estimated personal worth of $25 million and Cruise's estimated worth of $270 million, served to clearly establish how assets would be divided in the event of a divorce.
